1. Introduction

This privacy policy describes how Appfabriek ("we", "us", "our") handles information when you use the Agent Talk To Me app ("the App"). We attach great importance to your privacy and are transparent about what data we process.

3. What data we process

3.1 Data that stays on your device (not transmitted)

• Audio recordings: Speech recognition happens entirely on-device via the Apple Speech Framework. No audio is sent to our servers or third parties.
• Text-to-speech: Spoken responses are generated locally via Apple's AVSpeechSynthesizer.
• Conversation history: Conversations are stored locally via SwiftData on your device.
• Credentials: Pairing credentials are stored in the iOS Keychain on your device.

3.3 Data we do NOT collect

• No user accounts or personally identifiable information (name, email, etc.)
• No analytics or usage statistics
• No tracking or profiling
• No advertisements or advertising identifiers
• No location data

4. Legal basis for processing

We process your data based on the following legal grounds (Article 6 GDPR):

• Performance of the contract (Art. 6(1)(b)): Forwarding messages to your AI agent is necessary for providing the service.
• Consent (Art. 6(1)(a)): For sending push notifications, we explicitly request your consent through the operating system.

5. Data transfers and third parties

Your text messages are forwarded via our server (agenttalktome.com) to the AI agent you are paired with. This agent is managed by the party that provided you the pairing code — not by Appfabriek.

We do not sell data to third parties. We do not share data with third parties for marketing purposes.

Third-party services we use:

• Apple Push Notification Service (APNs): For delivering push notifications.

6. Security

• All communication between the app and our server uses HTTPS (TLS encryption).
• Real-time messages are sent via secured WebSocket connections (WSS).
• Credentials are stored in the iOS Keychain, the most secure storage mechanism on the device.
• The app uses no user accounts — only an anonymous pairing code.

7. Retention periods

Server-side data (messages, device tokens) is retained as long as the pairing between your device and the AI agent is active. When the pairing is terminated, the associated data is deleted.

Local data (conversation history, credentials) can be deleted by removing the app from your device.

8. Your rights (GDPR)

Under the General Data Protection Regulation you have the following rights:

• Right of access: You can request which data we process about you.
• Right to rectification: You can have incorrect data corrected.
• Right to erasure: You can request that we delete your data.
• Right to restriction: You can restrict the processing of your data.
• Right to data portability: You can request your data in a common format.
• Right to object: You can object to the processing of your data.

If you believe we are handling your data improperly, you have the right to file a complaint with the Dutch Data Protection Authority (autoriteitpersoonsgegevens.nl).

9. Children

The App is not directed at children under the age of 16. We do not knowingly collect data from children. If you suspect a child under 16 is using the App, please contact us.

10. Changes to this policy

We may update this privacy policy from time to time. Changes will be published on this page with an updated date. In case of significant changes, we will notify you via the App.
